Fiserv hit with overtime lawsuit

The law firm of Stember Feinstein Doyle & Payne, LLC has filed a collective action lawsuit to recover unpaid overtime under the Fair Labor Standards Act ("FLSA") for salaried help desk, client support, customer service, and account management workers who have been employed by Fiserv (NASD: FISV) or its subsidiaries, including Fiserv CIR, during the past three years.

The lawsuit is pending in the U.S. District Court for the Western District of Pennsylvania.

The lawsuit concerns whether certain salaried current or former employees of Fiserv or its subsidiaries working in help desk, client support, customer service, or account management positions were misclassified as exempt from the over-time provisions of the FLSA and were not paid time and one-half their regular hourly rate for any hours worked in excess of forty each work week.

If you have been employed by Fiserv or its subsidiaries, including Fiserv CIR, at any point during the last three years and have held a help desk, client support, customer service, account management or other similar position and have not been paid over-time for all hours worked over forty (even if paid on a salary basis) for each work week, you may have legal claims under the FLSA.
