The European Banking Authority (EBA) has published a decision setting out the procedural rules to regulate the establishment and functioning of an independent panel to facilitate the impartial settlement of cross-border disagreements between competent authorities.
The EBA decision includes rules on:
- the composition and appointment of the panel (Article 2);
- voting (Article 3); and
- the conciliation phase (Article 4); and
- the decision phase (Article 5).
The EBA decision entered into force on 24 February 2014. Under Article 8 the EBA annual report will include details of the nature and types of disagreements brought before the EBA and the Panel’s decisions.
